Hot Yoga Club SV, LLC WAIVER/DISCLAMER FORM

As with any physical activity, the risk of injury, even serious or disabling, or death, is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will listen to my body, discontinue the activity, and ask for support from the instructor. I assume full responsibility for any and all damages, which may incur through participation. By signing, I affirm that a licensed physician has verified my good health and physical condition to participate in such a program. In addition, I will make the club head aware of any medical conditions or physical limitations before class. If I am pregnant, become pregnant or I am post-natal or post-surgical, my signature verifies that I have my physician's approval to participate. I also affirm that I alone am responsible to decide whether to practice yoga and participation is at my own risk. 

RULES AND REGULATIONS: You agree to be bound by HOT YOGA CLUB SV LLC's Rules and Regulations regarding use of HOT YOGA CLUB SV LLC's facilities and conduct at the HOT YOGA CLUB SV LLC. These Rules and Regulations will be posted from time to time in the HOT YOGA CLUB SV LLC. These Rules and Regulations can be changed by HOT YOGA CLUB SV LLC at HOT YOGA CLUB SV LLC's discretion, without notice. HOT YOGA CLUB SV LLC employees and staff reserve the right to refuse service to anyone for any reason. HOT YOGA CLUB SV LLC's current Rules and Regulations include the following:

A. Dress Code: Fully dressed in dean exercise attire that does not overtly expose yourself to include: shirt, shorts and shoes.

B. Hygiene: HOT YOGA CLUB SV LLC requires members to observe high standards of hygiene, to include, but not limited to: grooming, oral, skin, nails, and clean clothing to include shoes, personal equipment, and body odor. Members must also dean their perspiration from equipment or floor.

C. Use of Facilities: It is the member's responsibility to ensure that all aspects regarding the use of the facility are explained and fully understood. Use of the facility which is interpreted by the management to be abusive in any manner such as, but not limited to: damage or improper use of equipment or inappropriate behavior to other members or staff, vandalism, littering and causing stains on carpet are grounds for HOT YOGA CLUB SV LLC to revoke your membership privileges and require you to pay your passes due in full.

D. Demeanor of Members: While members are on HOT YOGA CLUB SV LLC's premises, they shall refrain from using loud, foul or slanderous language. They shall also refrain from molesting, badgering, making disparaging remarks or soliciting other members and staff, including the use of social media. Private discussion with instructors will be only outside of the Hot Room and not during any class time. They will refrain from talking during savasana or meditation times. No weapons are allowed in the facility at ay time.

RIGHT TO CHANGE FACILITIES AND SERVICES: HOT YOGA CLUB SV LLC also has the right to determine the days and hours during which the HOT YOGA CLUB SV LLC will be available to members and the services and equipment which will be available. HOT YOGA CLUB SV LLC also reserves the right to refuse service to anyone.

The undersigned, the family hereby releases, waive, discharges and covenants not to sue Hot Yoga Club SV LLC Health Fitness, officers, employees and instructors of exercise classes (hereinafter referred to as ~releasees~) from all liability to the undersigned for any loss or damage, and any claim or demands therefore on account of injury to the person or property, or resulting in death of the undersigned, while the undersigned is in, upon, or about the premises or any facilities or equipment, therein. The undersigned hereby agrees to indemnify and save and hold harmless the releasees and each of them from any loss, liability, damage or cost they may incur due to the presence of the undersigned in. upon or about Hot Yoga Club SV LLC Health Fitness premises or in any way observing or using any facilities or equipment of Hot Yoga Club SV LLC.

I hereby agree to irrevocably release and waive any claims that I have now or may have hereafter against both Hot Yoga Club SV, LLC, and any of its members, heads, or instructors. I have read and fully understand and agree to the above terms of this Liability Waiver Agreement. I am signing this agreement voluntarily and recognize that my signature serves as complete and unconditional release of all liability to the greatest extent allowed by law in the State of Arizona. By signing this release, I hereby waive and release Hot Yoga Club SV, LLC; Mary Elizabeth Medley-Baker, head of Hot Yoga Club SV, LLC; Daniel Diaz owner of Buena Health and Fitness Center at 255 W. Wilcox Ave, Sierra Vista, AZ from any and all liability, past, present, and future relating to injury or death pertaining to practicing yoga. I also herby acknowledges and agree that: my participation in live classes at the yoga studio includes the possible exposure to and illness from infectious diseases, including, without limitation, COVID-19. I KNOWINGLY AND FREELY ASSUME ALL RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF Hot Yoga Club SV, LLC or others, and assume full responsibility for my participation in live classes at the yoga studio, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Hot Yoga Club SV, LLC, and their officers, shareholders, employees, agents, and attorneys (collectively, the “RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, OR DEATH, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law. I HAVE READ THIS ASSUMPTION OF RISK, WAIVER AND RELEASE RELATING TO COMMUNICABLE DISEASES, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
